GENERAL TERMS AND CONDITIONS OF SALE

Prints of Galerie d'Art Beyrouti
Although our images are regularly monitored, certain works may be temporarily or permanently unavailable from our photoengraver–printer.  The unavailability of one or more images shall not incur the liability of the Galerie d’Art Beyrouti.
Should one or more images become unavailable, the Galerie d’Art Beyrouti will personally inform the client as soon as possible, either by email or by post.
The photographs illustrating the editions are not contractually binding. In the event of an error, the Galerie d’Art Beyrouti shall not, under any circumstances, be held liable.
All images are available in limited editions. For any questions relating to an order, cancellation or exchange, please contact us.

Orders
Orders may be placed in the following ways:

Any order submitted online will be confirmed by the Galerie d’Art Beyrouti by email, provided that the client has supplied all requested information.

Automatic registration systems are deemed proof of the nature, content and date of the order. The Galerie d’Art Beyrouti will confirm acceptance of the order by email to the address provided by the client. The Galerie d’Art Beyrouti reserves the right to cancel any order from a client involved in a dispute concerning payment for a previous order.

Furthermore, the Galerie d’Art Beyrouti reserves the right to cancel any order from a client unable to provide proof of a valid delivery address. The information provided by the purchaser when placing an order is binding. In the event of an error in the recipient’s address details, the seller shall not be held responsible for any failure to deliver the editions.

Prices

Prices indicated in euros are deemed inclusive of all taxes but exclusive of handling and shipping costs. Prices shown in currencies other than euros are provided for guidance only.

Prices may be changed at any time without prior notice; however, editions will be invoiced at the rate in force at the time the order is recorded.

Shipping costs are understood as a flat fee covering packaging and postage. The geographical delivery zone and shipping method selected by the client determine the amount of shipping charges.

Please ensure that all products are grouped within a single order. We cannot combine separate orders, and shipping costs will be charged for each of them.

For orders dispatched outside mainland France, customs duties or other local taxes (local VAT, customs tax, import duties, etc.) may be payable. These charges are the sole responsibility of the client, both in respect of declarations and payments to the competent authorities.

The editions remain the property of the Galerie d’Art Beyrouti until payment has been received in full, regardless of the delivery date.

Payment Terms
All prices are inclusive of tax (TTC).
Payment may be made
either by cheque (to be sent with the order form) ) or by credit card via the secure PayPal system.
Preparation and dispatch of the order will take place only upon receipt of payment.
Cheques are not cashed until we have verified proper receipt of the order (telephone contact at +33 6 33 77 73 81 or by email).
Payment by credit card is also available when editions are collected directly from the Galerie Beyrouti in Honfleur, Cour de Roncheville. The following cards are accepted: Carte Bancaire, Visa, Eurocard Mastercard Maestro, American Express and JCB. For purchases between a minimum of €200 and a maximum of €2,300 collected directly from Honfleur, payment in four instalments without fees may be arranged.

Payment
The price invoiced to the client is the price stated on the order confirmation sent by the Galerie d’Art Beyrouti. The purchase amount is payable in full on the date of the effective order.

Payment may be made:
- By credit card: through the PayPal system.
- By cheque: payable in euros and drawn on a French bank, made out to Galerie d’Art Beyrouti. In this case, the order will be processed only upon receipt of the cheque.

An order validated by the client will be considered effective only when the relevant banking centres have given their approval. In the event of refusal by those centres, the order will automatically be cancelled and the client notified by email.
Moreover, the Galerie Beyrouti reserves the right to refuse any order from a client with whom a dispute already exists.

Delivery
Products are delivered to the address indicated at the time of ordering. To ensure optimal delivery, it is recommended to provide an address where the order can be received during normal working hours.
The delivery times indicated at the time of ordering are average times given for guidance only and may vary depending on the destination. In the event of a delivery delay or stock shortage, whether at the Galerie d’Art Beyrouti or at its photoengraver–printer, the Galerie d’Art Beyrouti shall not be held liable.
If you choose to pay by cheque, the order will be processed only upon receipt of payment, and the dispatch and processing times for your order will be extended accordingly.
For deliveries outside mainland France, the items ordered are imported into the destination country by and under the responsibility of the client. It is the client’s duty to obtain any necessary information from the local authorities and to ensure strict compliance with the import regulations applicable to the editions in the destination country. Any customs duties or local taxes are payable solely by the client.
Possible delays in delivery shall not give the purchaser the right to claim damages or compensation. The following shall be considered cases of force majeure releasing the seller from the obligation to deliver: war, riot, fire, strike, accident, adverse weather conditions, or inability to obtain supplies.
Goods always travel at the recipient’s risk. Please check your parcel upon arrival. You have 48 hours to submit any claims to the carrier in the event of missing or damaged items.

Transfer of Ownership – Transfer of Risk
Ownership of the editions is transferred to the purchaser only after full payment of the price, regardless of the date of delivery of said editions.
However, the risk of loss or damage to the editions passes to the purchaser upon delivery of the said editions.

Legal Information
The Galerie d’Art Beyrouti treats all customer information with the utmost confidentiality..
Providing personal data required for distance selling is mandatory, as such information is essential for processing and shipping orders and for issuing invoices. Failure to provide the necessary details will result in the order not being validated.
Data entered online are recorded on a secure server and immediately encrypted.
In accordance with the French Data Protection Act (“Informatique et Libertés”), the processing of personal data relating to customers has been declared to the Commission Nationale de l’Informatique et des Libertés (CNIL).
Under Article 34 of the Law of 6 January 1978, customers have the right to access, modify, correct, and delete data concerning them. This right may be exercised by contacting the Galerie d’Art Beyrouti.
Furthermore, the Galerie d’Art Beyrouti undertakes not to disclose, either free of charge or for consideration, any customer contact details to third parties.

Disclaimer of Liability
The information and photographs of the editions contained in the databases of the website www.beyrouti.fr are provided for guidance only.
The photographs and texts reproduced on the site to illustrate the editions are not contractually binding. Consequently, the Galerie d’Art Beyrouti cannot be held liable in the event of an error in any of these photographs or texts.
The Galerie d’Art Beyrouti shall not be held responsible for non-performance of the contract due to stock shortages or unavailability of the editions, for total or partial strikes affecting delivery services, or for cases of force majeure such as flooding, fire, and similar events.
Nor shall the Gallery be held responsible for the content of any external websites accessible via hyperlinks from its own website.

Disputes
Online sales carried out by the Galerie d’Art Beyrouti through its website are governed exclusively by French law. This contract is subject to French jurisdiction.
In all cases, the Galerie d’Art Beyrouti’s liability shall be limited to the amount of the order and may not be invoked for simple errors or omissions that might remain despite all reasonable care taken in presenting the editions.
In the event of difficulties in applying this contract, the purchaser may, before taking any legal action, seek an amicable solution — for example, with the assistance of:
- a professional association in the relevant sector, - a consumer protection association, or - any other adviser of their choice.
It is recalled that seeking an amicable settlement does not interrupt the legal time limits of statutory or contractual warranties.
As a general rule, and subject to the assessment of the courts, compliance with the provisions of this contract relating to the contractual warranty implies that:
- the purchaser fulfils their financial obligations to the seller, and
- the purchaser uses the edition in a normal manner.
Claims or complaints will always be received with attentive goodwill, since good faith is always presumed in anyone who takes the trouble to explain their situation.In the event of a dispute, the client should first contact the Galerie d’Art Beyrouti to seek an amicable resolution.
Failing such resolution, the Commercial Court of Rouen shall have sole jurisdiction, regardless of the place of delivery or the accepted method of payment.
All clauses contained in these General Terms and Conditions of Sale, as well as all purchase and sale operations referred to herein, shall be governed by French law.

Scope and Acceptance of the Conditions
The client acknowledges having read, at the time of placing the order, the specific terms and conditions of sale set out on this page and expressly declares acceptance thereof without reservation.
These General Terms and Conditions of Sale govern the contractual relationship between the Galerie d’Art Beyrouti and its client, both parties accepting them without reservation. These General Terms and Conditions of Sale shall prevail over any other conditions appearing in any other document, unless a prior, express and written exemption has been granted.
The data recorded by the Galerie d’Art Beyrouti shall constitute proof of all transactions and financial operations carried out by the client.
These General Terms and Conditions of Sale, together with the applicable prices, are expressly approved and accepted by the purchaser, who acknowledges full knowledge thereof and, as a result, waives the right to rely on any contradictory document — in particular, their own general purchasing conditions. Placing an order implies full acceptance of these General Terms and Conditions of Sale.
These General Terms and Conditions of Sale may be amended at any time without prior notice.
